Terms of Service

1. What ClearBind does
ClearBind coordinates underwriting-repair work for insurance agencies and brokers: we read carrier inspection findings, produce itemized repair estimates, collect homeowner approval and payment, dispatch vetted independent contractors, and deliver completion documentation. ClearBind is not an insurance company, does not adjust or handle insurance claims, and does not provide insurance advice.
2. Accounts
Agency, agent, and contractor accounts are created by invitation. You are responsible for keeping your login credentials secure and for activity under your account. Homeowners do not create accounts; they act through secure links sent on behalf of their agency.
3. Estimates, approvals, and payment
Estimates are based on carrier inspection findings and are approved and paid by the homeowner before work is scheduled. Payments are processed by Stripe; ClearBind does not store card numbers. The price shown at approval is the full price — agencies are never billed for repairs.
4. Contractors
Repair work is performed by independent contractors, not by ClearBind employees. ClearBind verifies insurance coverage and performs background screening before contractors join the network, reviews completion evidence before releasing payment, and coordinates re-work when something falls short. Contractors are responsible for the quality and safety of their work and for maintaining required licenses and insurance.
5. Completion documentation
Completion packages (scope, photographs, verification page) are furnished as evidence that flagged work was performed. Underwriting decisions remain solely with the carrier.
6. Acceptable use
You agree not to misuse the service: no unauthorized access, no scraping, no uploading content you lack rights to, and no use of the platform for claims work or any unlawful purpose.
7. Disclaimers and limitation of liability
The service is provided “as is.” To the maximum extent permitted by law, ClearBind’s aggregate liability arising out of the service is limited to the amounts paid to ClearBind for the transaction giving rise to the claim. ClearBind is not liable for indirect, incidental, or consequential damages.
8. Termination
We may suspend or close accounts that violate these terms. Agencies and contractors may close their accounts at any time; obligations related to in-progress jobs survive until those jobs conclude.
9. Governing law
These terms are governed by the laws of the State of Texas. Disputes will be resolved in the state or federal courts located in Travis County, Texas.
